Terms of Service

These terms (“Terms”) govern your use of PodAir, a browser-based remote podcast studio (“Service”) operated by PodAir. By creating an account or using the Service you agree to these Terms.

1. Accounts

You must be at least 13 years old (or 16 in the EEA) to use the Service. You are responsible for activity that occurs under your account and for keeping your credentials secure.

2. Your Content

You retain all rights to the audio, video, and other content you record, upload, or generate through PodAir (“Your Content”). You grant us a limited, non-exclusive license to host, process, transcode, transcribe, and deliver Your Content solely to operate the Service for you and the participants you invite.

You represent that you have the rights to any content you publish into a session, including consent from every participant you record.

3. Acceptable Use

You may not use PodAir to record participants without their knowledge where consent is required, to infringe intellectual property, to distribute malware, to harass or threaten others, to violate applicable law, or to abuse service capacity.

4. Plans, Billing, and Cancellation

Paid plans renew on a monthly or annual cycle. You may cancel at any time; cancellation takes effect at the end of the current billing period. Pricing and plan features are listed on our pricing page and may change with notice.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, and unforeseen incidents may cause downtime. We are not liable for loss of recordings that result from participant disconnection, browser crashes, or device failure; we strongly recommend keeping a local backup when recording important content.

7. Termination

We may suspend or terminate your account if you violate these Terms or if required by law. On termination we will provide a reasonable window to export Your Content before deletion.

8. Disclaimers

The Service is provided “AS IS” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, PodAir’s total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware, except where prohibited by law.

11. Changes

We may update these Terms. Material changes will be announced by email at least 7 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance.
